Do I need a privacy policy for texting?

Yes. All major wireless carriers require an acceptable privacy policy to become a registered sender.

Here, we outline the parts of a privacy policy that are typically included to ensure compliance.

Not providing a compliant privacy policy can delay your registration and prevent you from

sending texts to your audience.

Required items for your privacy policy

  1. The personal information you collect

This might include details like names, phone numbers, and message content when users opt into your services.

Example: "We collect information such as names, phone numbers, and message content when you opt into our services."

  2. How you use the collected information

This should explain why you collect personal information and how you plan to use it.

Example: “We use your information to send text and voice messages, manage your account, and improve our services. This includes personalizing your experience and providing customer support.”

  3. How you share the information

Specify with whom you share data and under what circumstances. It is important to specify that personal information will not be shared with third parties for marketing or promotional purposes. If you do not include this in your privacy policy.

Example: “Your information will not be shared with third parties/affiliates for marketing/promotional purposes. Regardless of the above, text messaging originator opt-in data and consent information will not be shared with any third parties.”

  4. How to opt-out of further communications

Your privacy policy must share information about how to opt out of further communications, particularly text messages.

Example: “If you wish to be removed from receiving future communications, you can opt-out by texting STOP, QUIT, END, REVOKE, OPT-OUT, CANCEL, or UNSUBSCRIBE.”

The absence of any of these elements will likely result in your registration being rejected.
Please note that if a privacy policy generator is used, we recommend reviewing, editing,
and/or amending the policy to verify that it covers this point.
